1. Agreement to Terms

These Terms of Service (“Terms”) constitute a legally binding agreement between you (“User,” “you,” or “your”) and Zero Index Labs LLC (“Company,” “we,” “us,” or “our”), the operator of Camp-Now (https://camp-now.com). By accessing or using our website, mobile applications, or any related services (collectively, the “Service”), you agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use the Service.

Camp-Now is a product and service of Zero Index Labs LLC, a limited liability company.

2. Description of Service

Camp-Now provides a campsite availability monitoring and notification service. The Service monitors recreation.gov and other camping reservation platforms for campsite availability based on user-defined criteria and may automatically add available campsites to users' shopping carts and/or send notifications when availability is detected.

IMPORTANT: Camp-Now is an independent service and is not affiliated with, endorsed by, or sponsored by Recreation.gov, the U.S. Department of the Interior, the National Park Service, the U.S. Forest Service, or any other government agency.

3. User Accounts and Recreation.gov Credentials

To use certain features of the Service, you may be required to provide your recreation.gov login credentials. By providing these credentials, you:

• Represent that you are the authorized holder of those credentials
• Authorize Camp-Now to access recreation.gov on your behalf
• Understand that Camp-Now may add items to your recreation.gov shopping cart
• Acknowledge that you remain solely responsible for completing any reservations and payments
• Accept all risks associated with sharing your credentials with a third-party service

We implement industry-standard security measures to protect your credentials, but we cannot guarantee absolute security. You agree to notify us immediately of any unauthorized access to your account.

4. No Guarantee of Reservations

Camp-Now DOES NOT GUARANTEE THAT YOU WILL SUCCESSFULLY OBTAIN ANY CAMPSITE RESERVATION. The Service is designed to improve your chances of finding available campsites, but:

• Campsites may be reserved by others before you can complete checkout
• Technical issues may prevent notifications or cart additions
• Recreation.gov may change their systems, APIs, or policies at any time
• Cart items may expire before you complete payment
• Your specified criteria may not match actual availability

You acknowledge that campsite availability is competitive and that using our Service does not entitle you to any reservation.

5. SMS/Text Messaging Terms

By providing your phone number and opting in to receive text messages from Camp-Now, you consent to receive recurring automated text messages regarding:

• Campsite availability alerts matching your watch criteria
• Booking and cart notifications
• Account and security notifications
• Service updates and announcements

Message Frequency

Message frequency varies based on your watch settings, campsite availability, and account activity. You may receive multiple messages per day during high-availability periods.

Opt-Out

You can opt out of SMS messages at any time by replying STOP to any message. After opting out, you will receive a single confirmation message and no further SMS messages will be sent. You may also disable SMS notifications in your account settings.

Costs

Message and data rates may apply depending on your mobile carrier and plan. Camp-Now does not charge for SMS messages, but your carrier may charge standard messaging fees.

Carrier Liability

Carriers (AT&T, Verizon, T-Mobile, etc.) are not liable for delayed or undelivered messages. Message delivery is subject to effective transmission from your network operator.

Supported Carriers

Our SMS service is available on most major U.S. carriers. Some carriers may not support all message types or features.

6. Fees and Payment

Camp-Now may offer free and paid subscription tiers. By subscribing to a paid plan, you agree to pay all applicable fees. Fees are non-refundable except as required by law or as expressly stated in these Terms. We reserve the right to change our pricing at any time with reasonable notice to existing subscribers.

Any fees charged by recreation.gov or other booking platforms for campsite reservations are separate from and in addition to any Camp-Now subscription fees.

7. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Attempt to circumvent any rate limiting or access controls
• Resell, redistribute, or commercially exploit the Service without authorization
• Use automated tools to access the Service beyond normal usage
• Interfere with or disrupt the Service or servers
• Impersonate any person or entity
• Use the Service in any way that violates recreation.gov's terms of service
• Create multiple accounts to circumvent usage limits

8. Intellectual Property

The Service, including all content, features, and functionality, is owned by Zero Index Labs LLCand is protected by copyright, trademark, and other intellectual property laws. “Camp-Now” and associated logos are trademarks of Zero Index Labs LLC. You may not use our trademarks without prior written consent.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, secure, or error-free, that defects will be corrected, or that the Service is free of viruses or other harmful components. We make no guarantees regarding the accuracy, reliability, or availability of any information provided through the Service.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, Zero Index Labs LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, REGARDLESS OF WHETHER SUCH DAMAGES ARE BASED ON WARRANTY, CONTRACT, TORT, STATUTE, OR ANY OTHER LEGAL THEORY.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

11. Indemnification

You agree to indemnify, defend, and hold harmless Zero Index Labs LLC and its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights, including recreation.gov's terms of service
• Any content or data you submit through the Service

12. Dispute Resolution and Arbitration

Binding Arbitration: Any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be resolved by binding arbitration administered by the American Arbitration Association (“AAA”) in accordance with its Consumer Arbitration Rules.

Class Action Waiver: YOU AGREE THAT ANY ARBITRATION OR PROCEEDING SHALL BE LIMITED TO THE DISPUTE BETWEEN US AND YOU INDIVIDUALLY. YOU WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION.

Small Claims Exception: Notwithstanding the above, either party may bring an individual action in small claims court for disputes within the court's jurisdiction.

Opt-Out: You may opt out of this arbitration agreement by sending written notice to support@camp-now.com within 30 days of first accepting these Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions. For any disputes not subject to arbitration, you consent to the exclusive jurisdiction of the state and federal courts located in Delaware.

14. Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on the Service and updating the “Last Updated” date. Your continued use of the Service after such modifications constitutes your acceptance of the updated Terms.

15. Termination

We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Service will cease immediately. Provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

16. Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be modified to the minimum extent necessary to make it valid and enforceable.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Zero Index Labs LLC regarding the Service and supersede all prior agreements and understandings.
